It happens every single year.
The school year kicks off with brand-new backpacks, fresh supplies, and high hopes. You sign off on your child’s Individualized Education Program (IEP), assume everyone on campus is aligned, and plan to wait for the first official progress report in November to see how things are going.
Then November arrives. You sit down across from the teacher, open the progress report, and realize something is terribly off.
The speech therapy sessions promised twice a week haven't been happening due to staffing shortages. The sensory breaks written into the accommodations plan were forgotten three weeks ago. Your child hasn't been slumping in their performance because they aren't trying—they've been struggling because their state-mandated support services never actually started.
If you wait until November to audit your child’s IEP, you lose nearly three months of crucial developmental progress. Here is why you need to check your child’s IEP services right now—and the exact steps to do it today.
When early-semester delays surface, parents are often told to "give it a few weeks for the classroom routine to settle."
While general education classrooms do take time to find their rhythm, special education services are legal mandates under federal law and Florida state guidelines—not optional perks.
An IEP is not a work-in-progress that slowly rolls out as the semester unfolds. If an accommodation, therapy, placement, or support is written into your child’s IEP, it must be provided immediately starting from Day One.
To ensure schools stay accountable from the very start of the term, Florida updated state law (HB 1279) with critical parent protections regarding IEP service delivery:
Mandatory 10-Day Notice for Missed Services: If a related service (such as speech, occupational, or physical therapy) identified in your child's IEP is not provided as scheduled, the school district must notify you in writing or electronically within 10 school days. The notice must explain why the service was missed and outline a clear plan for make-up sessions.
Access to Service Logs Within 15 Days: You have the legal right to request and inspect all service provider logs or progress notes. The district is required to grant access within 15 school days of the service being provided.
Waiting weeks to check on missed minutes only widens learning gaps and makes it harder to schedule compensatory sessions down the road.

You do not need to wait for a formal invitation or an end-of-quarter report card to review your child's routine. Follow these four practical steps to conduct a quick audit right now:
Pull out your child’s current IEP document and navigate to the Special Education and Related Services page. Note the exact frequency and length of each service (e.g., 60 minutes per week of occupational therapy).
Reach out to the teacher or service provider to ask which specific days and times those pull-out or push-in sessions take place on your child's weekly schedule.
Therapists and ESE specialists keep formal logs tracking the exact dates, times, and targeted goals addressed during each session.
Under HB 1279, you can request these records at any time. Send a brief email to your child's ESE coordinator or therapist:
"Hi [Name], I'm doing a quick beginning-of-year check on [Child's Name]'s IEP routine. Under Florida's updated guidelines, could you please share the service logs or progress notes showing the dates and times for therapy sessions completed so far this month? Thanks!"
Accommodations change how your child accesses the curriculum. Common early-semester gaps occur when general education teachers are not fully aware of specific classroom adjustments.
Check in on core daily accommodations:
Seating Modifications: Is your child seated near the front or away from distractions as specified?
Assistive Technology: Are tools like speech-to-text software, specialized seating, or adaptive keyboards set up and actively being used?
Testing Modifications: Are extended time allowances, quiet settings, or chunked assignments being honored on daily classwork?
Maintain a dedicated physical binder or digital file for the current school year. Keep track of:
Written notices from the school regarding any missed sessions or scheduling changes.
Dated copies of emails sent to teachers, therapists, and administrators.
Work samples brought home that show whether accommodations (like reduced problem sets or visual checklists) are being applied.
If your audit reveals that services are not being provided as written:
Document the Specific Gap: Note exactly which service or accommodation is lacking, how long it has been delayed, and whether you received the required 10-day written notice from the district.
Put Concerns in Writing: Avoid relying solely on phone calls or verbal check-ins. Send a clear email to the principal, ESE coordinator, and IEP team leader detailing the missing support minutes.
Request an IEP Team Meeting: You have the right to request an IEP meeting at any point in the school year—you do not have to wait for the annual review.
Establish a Make-Up (Compensatory) Plan: Work with the team to establish how and when missed therapy hours will be made up so your child stays on track with their goals.
Checking your child’s IEP early guarantees that they get the full support guaranteed to them by law right from the start.
